Pennsylvania and New Jersey courts will enforce non-competes only if they protect a legitimate business interest and are reasonable in scope, geography, and duration – overbroad ones are often narrowed or struck down. Enforceability is also a fast-moving area of law nationally, so have any non-compete reviewed against current rules before you sign or assume you are bound.
